GENERAL CONDITIONS OF USE AND CONTRACTING OF GYM FIT VILLACAÑAS

SCOPE OF APPLICATION

Read carefully all the articles corresponding to the General Terms and Conditions (hereinafter, "General Conditions"), which regulate the contractual relationship between GYM FIT VILLACAÑAS, S.L, with address in Villacañas (Toledo), Calle Tejeruelas, 96, 45860, and with NIF B19963875 (hereinafter, Gym Fit Villacañas) and its partners, establishing rules for the use of facilities, access to services and the obligations derived from the subscription of plans or fees (hereinafter, memberships).

If you agree and join as a member and make use of the facilities and services of Gym Fit Villacañas, it will imply the acceptance of these General Conditions along with the particular conditions that may be established in each contract. On the contrary, if you do not join as a member, you will not be able to use the facilities and services of Gym Fit Villacañas.

These General Conditions will be applicable from October 1, 2025, based on Law 5/2015, of March 26, on Physical Activity and Sport of Castilla La-Mancha, as well as the applicable civil and consumer regulations, for all plans subscribed from the date.

ARTICLE 1. MEMBERSHIP

Any person who has formalized his registration by signing the corresponding contract in person or digitally and paying for the contracted membership will be considered a member. The membership status is strictly personal and non-transferable. Access to the facilities will be made only through an enabled control system (QR or Gym Fit card), being the responsibility of the member its custody and immediate notification in case of loss or theft if you have a Gym Fit card.

ARTICLE 2. SERVICES

Gym Fit Villacañas provides users with an area of bodybuilding and cardio machines, group classes run by monitors, as well as special training and personalized programs. Certain services may be subject to an extra cost depending on the current membership.

ARTICLE 3. MEMBERSHIPS

At Gym Fit Villacañas we have different memberships where users can choose, each of them has their own characteristics, which can be consulted on the official website, in the facilities or by downloading our App.

ARTICLE 4. PAYMENT AND EXPIRATIONS

Memberships will be paid in the manner agreed at the time of formalization of the contract (Direct debit, card ...). In case of direct debit, the partner must guarantee sufficient funds, assuming the expenses derived from returns. The non-use of the facilities or the contracted services will not entitle you to any refund or refund, except in those cases expressly contemplated in the regulations or in the contract itself. The non-payment of two monthly payments may result in the immediate suspension of services and the termination of the contract. In addition, Gym Fit Villacañas reserves the right to pass on to the member the extraordinary expenses caused by any delay in payment.

ARTICLE 5. WITHDRAWAL AND CANCELLATIONS

The member must request the suspension of his contract before the 20th of the month preceding the one he wishes to terminate, which can be managed in person or through the enabled application. If it is not communicated within the deadline, the following month's fee will be charged without the right to a refund.

ARTICLE 6. MINORS

The minimum age of access is 14 years. Children under the age of 18 will need express written authorization from the parent or authors. Minors must access Gym Fit Villacañas only at the time when staff of the center are present.

ARTICLE 7. USE OF THE FACILITIES

The partner agrees to use the facilities and equipment responsibly, following the instructions of the staff and respecting the internal regulations of the gym. It is mandatory to use a towel and clean sports shoes. Smoking, consuming alcohol, drugs, anabolic substances or any unauthorized product is prohibited.

ARTICLE 8. GUESTS

Each member may invite a person at the time of registration and, subsequently, once a month, according to the conditions and schedules established by Gym Fit Villacañas.

ARTICLE 9. PERSONAL TRAINING

Paid personal training is not allowed inside the gym except those authorized by the management and those provided by the Gym Fit Villacañas gym.

ARTICLE 10. EXEMPTION OF LIABILITY

Gym Fit Villacañas will not be responsible for injuries, accidents or damages that may arise from the practice of sports, except for those attributable to direct negligence of the center. The member declares to be in adequate physical conditions for the performance of sports activity, being responsible for his own state of health and for reporting on pathologies or limitations.

ARTICLE 11. SCHEDULE

The gym will remain open to the public through access control (QR or Gym Fit card) from Monday to Sunday from 06:30 am to 10:00 pm. The service to the public will have a schedule from Monday to Friday from 09:00 h to 13:00 h and from 17:00 h to 21:30 h. On holidays Gym Fit Villacañas will remain closed, although members could access through an access control system.

ARTICLE 12: SUSPENSION AND RESOLUTION OF THE CONTRACT

The contract will have the duration agreed in the particular conditions, being extended automatically unless express notice of cancellation in the established terms. The partner may request the temporary suspension of his contract in duly justified exceptional cases (medical circumstances). Failure to comply with payment obligations or rules of use will entitle Gym Fit Villacañas to terminate the contract immediately.

ARTICLE 13. CONTRACTUAL MODIFICATIONS

The gym may update these general conditions for organizational, legal or security reasons. The changes will be notified with a minimum period of 15 days and were considered accepted unless expressly opposed by the member within the established period.

ARTICLE 14. PERSONAL DATA

The partner agrees to keep his personal and banking data up to date.

ARTICLE 15. DATA PROTECTION AND SURVEILLANCE

The personal data of the partner will be collected and processed in accordance with Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD) and the RGPD (EU) 2016/679. The partner accepts the processing of your data for contractual management, collections, communications and security.

Gym Fit Villacañas has surveillance cameras in order to be able to make video recordings and photographs in the facilities for security reasons, access control and surveillance of the correct use of services and facilities. The recordings will be kept for a necessary time and security measures will be taken to protect the information.

ARTICLE 16. IMAGES AND SOCIAL NETWORKS

Gym Fit Villacañas may take photographs and video recordings in its facilities and activities for exclusively promotional and communication purposes.

The partner may be captured in a secondary way in such images or videos. In no case will first plans or individualized content be made without the express consent of the partner. The member may at any time exercise his rights of opposition or revocation regarding the use of his image in the terms provided for in the data protection regulations (LOPDGDD and RGPD).

Gym Fit Villacañas is committed to a respectful, proportionate use and in accordance with the promotional purpose of these images.

ARTICLE 17. FINAL PROVISIONS

The nullity of any clause will not affect the rest of the conditions. This contract will be governed by the legislation in force in the autonomous community and supplementarily by Spanish legislation on consumers and users.
